Strengthening the protection of agricultural land against speculative buyout by domestic and foreign natural and legal persons, stopping the negative trend in the agrarian structure and the improvement of the economic situation of Polish farmers – are the main objectives today entering into force of the Act on trading in the ground.
The amendment of the Parliament adopted on April 14, and the president Andrzej Duda signed it last Tuesday, April 26. As pointed out by parliamentary press office, May 1, 2016 r. Shall cease to apply 12-year protection period for the purchase of agricultural land by foreigners. In this regard, the Act introduces the principles that should ensure compliance with the interests of the public use the land for agricultural purposes.
Under the new rules state agricultural land will remain at the disposal of the Agricultural Property Agency, and the primary means of its development will be beneficial to farmers permanent tenancy, providing ownership but control over the way their management. Sale of real estate (or parts thereof) – belonging to the Agricultural Property of the State Treasury – will be suspended for 5 years from the entry into force of the Act.
The buyers of agricultural property can only be farmers. The exception will be the acquisition of land by persons close to the seller, local government units and the Treasury. In the case of others the sale of land must be confirmed by the consent of the President of the Agricultural Property Agency.
The acquisition of property will be permanently connected to the requirement of the personal conduct of the farm and the prohibition of the sale and lease purchased the land for 10 years. Only in cases of random agreed to sell the land before that date will be able to give judgment. According to the adopted amendments to the Act to acquire agricultural land will also be able to churches and religious associations.
