Jacek Kurski won the lawsuit in Strasbourg. The case concerned “Newspapers … – Cable Republic

The European Court of Human Rights in Strasbourg ruled that Poland violated against the former PiS politician and now President of the Polish Television Jacek Kurski, Article 10 of the European Convention on Human Rights.

Kurski in May 2006 in the “worth talking” in TVP Polonia said that the article in “Gazeta Wyborcza” contains “all lies”. At the same time, the then deputy PiS stated that the newspaper devoted to “crazed attacks on Law and Justice”, because “the operating system media” with the company J & amp; S, importing the Polish fuel. The proof was to be a full-page advertisement J & amp; S brought on to the studio release. According to him it was not necessary needed because the company is a monopolist on the Polish market.

In response to the words Kurski Agora sued the current President of TVP on the protection of personal rights and won. The then deputy PiS appealed the first-instance judgment, but the Court of Appeal in Warsaw kept him in power. In connection with the decision of the court, the politician filed a cassation appeal, which after the diagnosis by the Supreme Court was rejected in November 2009.

Finally, Kurski appealed the judgments of Polish courts to the European Court of Human Rights in Strasbourg and the complaint alleged that his the right to freedom of expression had been violated. ECHR decided that in fact judgments of national courts in this case violate article 10 of the Convention of Human Rights and Fundamental Freedoms, which says that the right to freedom of expression includes freedom to hold opinions and to provide information “without interference by public authorities”.

In connection with the judgment Poland will have to pay Kurski 12.5 thousand. euro compensation and redress for damage and reimbursement of costs incurred.
