In connection with the work on the law on the Constitutional Court the Minister of Foreign Affairs Witold Waszczykowski asked the advisory body to the Council of Europe, which is the European Commission for Democracy through Law, also known as the Venice Commission, asking for an opinion on the legal issues which are the subject work on the amendment of the Law on the Constitutional Court.

Minister of Foreign Affairs indicated in his speech that there was political controversy surrounding the Court revealed not only the interpretative doubts about the wording of the current Constitutional Tribunal Act, but also lack of legal mechanisms allowing to solve complex issues, which have recently emerged in the judicial practice of the Court. Therefore reported to have been parliamentary draft amendment to the law.

The Minister Witold Waszczykowski therefore asks the Venice Commission with a request for an opinion on the proposed by the Sejm legal solutions in the belief that the Constitutional Court is one of the important elements institutional order of the Republic, and as soon as possible to end the controversy around it accrued. The Minister strongly believes that the international prestige of the Venice Commission and its professionalism allow an objective assessment of the legal issues which are the subject of the application.

The Venice Commission is the Council of Europe’s advisory body on constitutional matters. Its members are acting on their own behalf experts from Member States, among them university professors, specialists in the field of public law and international law, parliamentarians, officials. The Commission’s role is to provide legal advice to Member States, in particular to support them in the process of adaptation and improvement of law and institutional structures to European standards in the areas of democracy, human rights and the rule of law. The Commission is also involved in promoting and consolidate the constitutional acquis of the Member States. The Commission has been operating since 1990. At present it has 60 member states, 47 of which are state members of the Council of Europe.
