In imposing sentence, the chairman of the National Broadcasting Council granted the statutory requirements set out in Art. 53 paragraph. 1 of the Law on Broadcasting, ie. the scope and gravity of the infringement and the financial capabilities of the sender. When assessing the extent and gravity of the infringement into account the fact that timeout occurred in a public program, distributed free of charge throughout the country.
